A transformation project as an electoral offer

I have seen with great interest the emergence of a pre-candidacy for the opposition primaries that presents as its electoral offer a "transformation project for Venezuela" (see in Spanish El Impulso, Cesar Perez Vivas presents transformation project for Venezuela, in https://www.elimpulso.com/2022/06/15/cesar-perez-vivas-presenta-proyecto-de-transformacion-de-venezuela-15jun/).

Given that this "transformation project" that a pre-candidate supports as his electoral platform, raises some of the constitutional changes that we have considered fundamental to be addressed through an Original Constituent process, I consider it very important to address this discussion, since it could lead to confusion, if we make a comparison with the approach that the Alianza Nacional Constituyente Originaria, ANCO is making to the country with the project El Gran Cambio (se in Spanish The Great Change, A Proposal for the Refoundation of Venezuela, in https://ancoficial.blogspot.com/p/documentos-fundamentales.html), in contrast to the electoralist offer of the regime and those who believe that a significant change in the country's situation is possible through an electoral contest with criminals.

According to the published news, the pre-candidate César Pérez Vivas states:

"First, reduce the constitutional term from six years to five years.

Second, establishment of the absolute non-reelection of the President of the Republic.

Third, establishment of the second round to elect the president of the country.

Fourth, establishment of a bicameral Congress.

Fifth, establishment of the federal State so that the competences of the states and municipalities may be guaranteed, so that they may have the resources so that the authorities may solve the needs of the populations and not be dependent on a president who is in Caracas and who does not respond to his obligations".

We could not disagree with this approach. In fact, as I mentioned before, the proposal is part of the proposal that ANCO has made to the country to be debated by legitimately elected Constituents from all the regions of the country, within an Original National Constituent Assembly.

Unfortunately, in the published news, the pre-candidate does not address how he proposes to carry out such important constitutional changes within the framework of a situation of hijacking of all the public powers of the State. And even if he were to win the candidacy and also the Presidency of the Republic, with an opposition completely surrendered to the regime, it would remain to be seen how the President would be able to carry out such electoral promises with a completely renewed Supreme Court of Justice, a National Electoral Council turned into a roulette wheel in favor of the regime and an illegitimate National Assembly.

The above proposed changes cannot be implemented without the Constitutional redefinition of the Pact that all Venezuelans have given ourselves, through a National Constituent Assembly. That is to say, they cannot be addressed with an Amendment or a Reform because they imply important changes in the structure and fundamental principles of the Constitution, as established in Constitutional Articles 340 and 342. Consequently, they could not be part of the electoral promise of any candidate.

If the aforementioned constitutional changes are taken out of context, where the functions and attributions of all the Public Powers of the State (Municipal, State and National) must also be redefined, their mere enunciation can be misused as very attractive electoral promises, but impossible to fulfill without summoning the Original Power. It is not enough to say that a Federal State must be established, it must also be said how, and what functions the Public Powers of the State would have within a different political-territorial distribution, proposing a new one. This is part of the construct that ANCO recommends to debate in a Constituent Assembly.

If Venezuela were not in a situation of kidnapping by a narco-regime, this electoral proposal would resemble the one made by Hugo Chávez Frías to the country in 1998, when the then presidential candidate offered a "Constituent Assembly" to put an end to all the ills of Venezuela. And Venezuelans bought it, not because they knew what such a process implied, but because all parties -including the one where Pérez Vivas was a militant- had lost, as now, all credibility among voters, and did not vote in favor of Chávez but against them. We are no longer in that situation, so now offering constitutional changes decontextualized from Venezuela's political situation, could be interpreted in the best of cases as a deceitful electoral offer to the population.

Structural changes to the Constitution cannot be part of an electoral slogan. And if we truly believe in them, they must be proposed from the global perspective of a change, a Great Change, which must be proposed to the country and the International Community to structurally solve the serious damage that the regime has inflicted on our institutions, and as the fundamental vehicle to Refound the Nation among ALL the political actors of the country, including the party of the regime. It is about establishing a proposal for the Refoundation and Reconciliation of all factors. And it must be positioned above all the electoral political diatribe to which the regime and the political leaders of an opposition that has not yet understood the seriousness of the problem in which we find ourselves.

If all the political opposition of the country understood that the path of the Constituent Refoundation is the only offer that can be made to a country where all the Public Powers are kidnapped and distorted, the International Community, with the USA at the head, would not hesitate for a second to support this process, by putting the corresponding pressures on the regime of Nicolás Maduro Moros and his political opposition, in order to be able to summon the people outside the Venezuelan public powers, with the arbitration of an independent Constituent Electoral Tribunal, in which all the actors can trust. The elected Constituent would immediately dismantle the completely illegitimate and corrupt Executive, Legislative, Judicial, Electoral and Citizen Powers of Venezuela, thus reestablishing the constitutional course of the Republic.

As you will see, there is a substantive difference between ANCO's proposal and any transformation project made as an electoral offer within the framework of a tyranny, misusing the changes that the country requires for its Refoundation. Venezuelans must decide our destiny without confusion, and with a very clear conscience of the path that the country must follow for the peaceful reestablishment of democracy and freedom.
