The structural deficiencies of a tyranny

There are always two ways to present a glass with only half the water in it: either half full or half empty. The presentation made by the Chief of the European Union Electoral Observation Mission, Isabel Santos, of the Final Report of the regional and municipal elections of the regime held on November 21, 2021, resulted in a glass half full, with serious intentions of making it completely full (see in Spanish Final Report EU EOM Venezuela 2021, in https://eeas.europa.eu/election-observation-missions/eom-venezuela-2021/111308/informe-final-moe-ue-venezuela-2021_es).


Just saying that there were "better electoral conditions compared to past elections", although certain "structural deficiencies" persist" (see Publico.es, La Misión de la UE cree que hubo mejoras en las elecciones de Venezuela aunque persisten "las deficiencias estructurales", en https://www.publico.es/internacional/mision-ue-cree-hubo-mejoras-elecciones-venezuela-persisten-deficiencias-estructurales.html) is to tell the world and especially Venezuelans that a woman who is proven to be pregnant as a result of rape is "half" pregnant.


The definition of the word euphemism in the DRAE is the following: "1. m. A mild or decorous manifestation of ideas whose straight and frank expression would be harsh or rude". And indeed, it would be rude to say that these elections were flawed from beginning to end for being illegitimate and unconstitutional, including the appointment of the CNE Rectors. But Mrs. Santos preferred the euphemism "structural deficiency" to frame her report. And that was what Isabel Santos used to define what the regime of Nicolás Maduro Moros has done, not only with the Venezuelan electoral system but also with the country.


The first and main recommendation of the Final Report of the European Union Electoral Mission is nothing less and nothing more than the respect for the separation of powers, and that Justice functions in Venezuela, fundamental pillars of the Rule of Law in any country:


"Strengthen the separation of powers and confidence in the independence of the TSJ with the approval of a new Judicial Career Law and a reform of the Organic Law of the Judiciary approval of a new Judicial Career Law and a reform of the Organic Law of the Supreme Court of Justice, in order to align them with the constitutional guarantees that ensure a transparent, apolitical and Supreme Court of Justice, to align them with the constitutional guarantees that ensure a transparent, apolitical and merit-based selection of judges, avoiding the invasion of the competencies of the electoral power" (Page 11/88 of the Report).


And I ask myself: Which country do you think the EU Electoral Observation Mission arrived to, Narnia? By God! they arrived to the Venezuela of the tyranny in exercise of the militarized narco-regime of Nicolás Maduro Moros! The one that will NOT respect, as indeed most of the recommendations of this report conclude, every law, every regulation, every procedure in order to let any form of opposition be fairly measured in an electoral process. Of course there has to be a rule of law and a functioning justice to hold elections of any nature in a country! It was not necessary for them to come to realize that.


So, from that recommendation on down, any consideration in that Final Report is irrelevant and confirms what we wrote about Josep Borrell having ignored for political reasons the technical recommendations of the Report of the EU Exploratory Mission to Venezuela, carried out from July 8 to 23, 2021 (see The report Borrell ignored, in https://ticsddhh.blogspot.com/p/the-report-borrell-ignored.html). 


Then, why did the EU Electoral Observation Mission come here? To tell us something we already knew about the violation of the fundamental freedoms of Venezuelans, starting with our right to freely elect our authorities without the existence of a tyranny that violates our Human Rights? Or to cover up the barbarity happening in Venezuela with a euphemism, calling them "structural deficiencies"? Does the tyranny of Nicolás Maduro Moros have "structural deficiencies" that do not allow us to hold free, fair and verifiable elections? You have to have kidneys, not to say the right word, gentlemen of the European Union…


And this does not mean that the rest of the report does not contain truths such as the abuse of some observers by not being able to access the polling places on the day of the election, something that has been denounced countless times; or the deliberate delays in the opening and closing of the polling places; or the abuse of the PSUV, party of the regime, in the use of State resources for the benefit of its candidates; or the arbitrary disqualification of candidates by the Comptrollership of the regime; or the abuse of the media that are not pro-government, just to mention some of the things pointed out in this Final Report.


But to say that "The current board of directors of the National Electoral Council (CNE), appointed in May 2021, has often been described by EU EOM interlocutors and political commentators as the most balanced of the last 20 years" (Page 8/88), does not reflect reality. The appointment of these Rectors by a completely illegitimate and internationally unrecognized National Assembly leaves a fatal gap in this Final Report. The Rectors were the "convenient" ones for the regime and its opposition that accepted to go to that electoral farce.

 

Indicate "Although the three rectors close to the government had control of the CNE's executive bodies, the Council managed to improve the technical conditions of the elections. the executive bodies of the CNE, the Council managed to improve the technical conditions of the elections through internal dialogue, and the two rectors linked to the opposition and civil society did not hide their dissenting votes on issues where consensus could not be reached, such as the disqualification or resignation of candidates the disqualification or resignation of candidates" (Pages 8-9/88), gives a clear account of the flagrant violation of the spirit of the constitutional letter where the Rectors of the Electoral Power can be neither of the government nor of the opposition, revealing that those who are "of the government" are the ones who have the control of the electoral process over those who are not. 


The supposed "improvements" of this process in relation to the previous ones, according to this Electoral Observation Mission, vanish in the light of a framework of a tyranny-opposition association bought complicit, to give a democratic appearance to an electoral process that from the very beginning was illegitimate and irritating for all Venezuelans.


It is about time that the countries of the International Community, especially the European Union, stop considering what is happening in Venezuela as something so simple that can be solved with elections. Venezuelans have stopped buying little mirrors by paying the conquerors with gold several centuries ago. It will take more than a euphemism of an Electoral Observation Mission sent by a Spanish socialist to make us swallow that. Start by respecting the suffering and tragedy of the Venezuelan people…
