Venezuela: Beyond a few questions

More than once we have repeated that ANCO's proposal for a Plebiscitary Popular Consultation is far from being a repetition of the civic gesture of July 16, 2017. There is a considerable difference in this new proposal and the historical distance that separates it from 16J-2017. We have considered that the crisis of the country can only be solved by the People of Venezuela, and the only way for the people to express themselves to face the complexity of the crisis we are going through is by consulting them about the fundamental issues that afflict them.

Beyond entering into the specific wording of the questions that should be submitted to the consideration of the people in a Plebiscitary Popular Consultation (specific questions that would come up as a consequence of the issues to be addressed according to the topics we propose), what must be established are the fundamental issues that must be submitted to the decision of the People's Sovereignty. We believe that there are four (4) great minimum crucial issues that must be submitted to the decision of the Sovereign People to resolve the crisis in Venezuela:

1.- The permanence of Nicolas Maduro Moros in power

Argumentation

Beyond the conditions that surrounded the election of the de facto President of Venezuela and all the political and legal arguments put forward regarding the illegitimacy of his presidency, the last word is held by the depositary of sovereignty. The People must make a definitive statement regarding the presence of Nicolás Maduro Moros in power. That is the fundamental key to this process. It is the Sovereign People who decide, not the politicians of either side in the country, much less the International Community. It is the people of Venezuela. That has been our basic conceptual proposal. That the Venezuelan people express themselves and that the rest of the world respect and help us to materialize that decision based on the international principle of Self-Determination of Peoples.

2.- Dismantling of the National Constituent Assembly

Argumentation

Nicolás Maduro Moros called for the election of a National Constituent Assembly on May 1, 2017 without having the constitutional qualification to do so. The President of the Republic is one of the four possible conveners of a Constituent Assembly, but the final and definitive decision is made by the Sovereign People in a Popular Consultation, according to Article 348 of the Constitution. This consultation was not carried out. However, this completely illegitimate entity was elected and exercises its functions above any constitutional institution of the Republic. The only one who has the power to dismantle that entity is the People of Venezuela, so its existence must be submitted to their consideration.

Establishment of a Transitional Government Junta

Argumentation

Given the state of institutional destruction of the Republic, the election of a new President in the traditional manner is not enough. It is necessary to establish a Governing Junta covering a broad political and sectorial representation of the whole nation that can guarantee the stability of the transition. However, there is no constitutional provision for the formulation of a Governing board. The executive power according to the Constitution is exercised in Venezuela by the President and a Council of Ministers. Something different must be authorized by the Venezuelan people in a Popular Consultation. That is why the U.S. proposal of the Framework for Democratic Transition of Venezuela lacks a constitutional basis (see official U.S. proposal at https://www.state.gov/democratic-transition-framework-for-venezuela/).

This Board must be something much more elaborate than what happened on January 23, 1958 with the Governing Junta that led the country to the elections of December 1959. It should be composed of a broad political, military and civil society representation, and should be given broad powers in this Consultation to address the humanitarian, health, institutional and political crisis in Venezuela, in order to bring the country to a minimum state of functionality.

In the same way, the people must authorize in consultation the duration of this Governing Board until the convocation of elections of all public powers. These elections must be held through a completely new electoral system, adjusted to the decision of the Supreme Court of Justice Legitimate, in its Electoral Chamber, on June 13, 2018.

In the midst of the discussion of a possible extension of the constitutional period of the current National Assembly as a result of an upcoming illegitimate parliamentary election by the regime and its collaborators, the approval of the Sovereign People is essential. The mere fact of the mention of such an extension justifies in itself a Popular Consultation. The Governing Board would be appointed by the National Assembly before the end of its Constitutional period, and after approval in consultation with the Sovereign People. This leaves the holding of the People's Consultation as soon as possible for the remainder of the year 2020.

4.- People's authorization for the execution of the popular mandate

Argumentation

The result of this Popular Consultation is a mandate from the people. It should be obeyed without any reservations by those who exercise power in Venezuela. However, all Venezuelans know that the regime of Nicolás Maduro Moros has been responsible for the greatest period of violations of human rights and the Constitution that the Republic has suffered since its foundation. Therefore, even if the regime agrees to international pressure to carry out a consultation of the Venezuelan people in the territory of the Republic, we Venezuelans have to guarantee that the mandate that comes out of this consultation will be fulfilled. Only the people can authorize the International Community to do what is necessary to fulfill the mandate emanating from the People's Sovereignty, in exercise of the Principle of Self-Determination of the peoples. No country could deny us the necessary forceful assistance to force those who usurp public powers in Venezuela to comply with the mandate emanating from the people in this consultation, including the countries that make up the United Nations Security Council, if the people so express themselves directly. And if they still do not help us, any action by the Venezuelans, including force, to restore the validity of the Constitution would be legitimized by the popular vote.

The four (4) above topics summarize what the people should be consulted about and why, to begin the long road to recovery in Venezuela. Little by little people are becoming convinced that only the people of Venezuela have in their hands the recovery of the country. Nobody will come to help us if first each and every one of us does not take the first step. And only that step of the People's Sovereignty will be sufficient and definitive...
