The agony of questions and the scaffold of Guaidó

After weeks of discussions regarding the change in the questions posed by the National Assembly in the Accord approved on October 1st, we Venezuelans finally learned today the final text of the questions proposed to citizens by the Organizing Committee of the Popular Consultation, the High Citizens' Council and by the political sector headed by President Juan Guaidó and the National Assembly (see in Spanish, AN aprueba tres preguntas para la consulta opositora, in https://www.panorama.com.ve/politicayeconomia/AN-aprueba-tres-preguntas-para-la-consulta-opositora-20201119-0024.html).

 

From the proposal made by ANCO to this decision there is a big stretch, and although they finally understood that they should start with the Cessation of the Usurpation of Nicolás Maduro Moros in the first question, respecting the itinerary of the Statute for the Transition of February 2019, they skipped the Transition Government to reach the free, fair and verifiable elections. Some might say that the Transitional Government is "implicit" but there is a more far-reaching move that they will be able to understand later.

 

The rejection of the electoral event of December 6 of the second question was mandatory for the political sector because their parties have been kidnapped by the regime, which pretends to make elections with the traitors of those parties using their symbols. And a rejection by the population is necessary politically for them, but not for the people who cannot afford to eat. It seems to me that it would have made more sense if it had been held before the date, not after 6D-2020. But this lack of knowledge makes different and even more important political sense that is explained below.

The third question is whether it is in better tune with our original proposal ordering those who represent us to do what is necessary before the International Community for the rescue of democracy and freedom in our country. However, the intention of ANCO's proposal was based on a different criterion. Our proposal was that if the mandate of the people, ordered in this Consultation, was not fulfilled, we would give openness and authorization to the countries of the International Community that wished to help us in the rescue of our democracy and freedom, to do what was considered necessary and pertinent to give full compliance to the international pacts and agreements assumed and that are law of the Republic, such as the Responsibility to Protect (R2P).

 

The Government in Charge has not yet understood the real substance of our proposal, which is nothing more than to evict immediately and in any way a regime that is causing much harm to us Venezuelans, by the hand of the Popular Sovereignty. And although I personally disagree with the final wording of the questions of this Popular Consultation, at least this one has the minimum ingredients necessary to make it a rejection of the regime of Nicolás Maduro Moros by the people.

 

But there is something else we have to take into account: this Popular Consultation is the LAST opportunity for Juan Guaidó Marquez and his Legitimate Government to lead a transition to democracy and freedom in Venezuela. If they had understood this, they would have not only accepted ANCO's proposal months ago, but would have assumed it as their own and motorized it all over the planet. In a petty way they dedicated themselves to change it and if it were not for the decisive accompaniment of the civil society to our struggle throughout the country, they would not have even considered as the first point of capital importance the Cease of Usurpation of Nicolas Maduro Moros, placing then the elections they want without going through a Transition Government.

 

The political forces are already moving in the direction of removing Juan Guaidó from the Presidency in Charge as of January 5, 2021, the date of the beginning of a new Legislature and National Assembly, at the expiration of the current one presided over by the Popular Will and Juan Guaidó, at midnight on January 4, 2021. The aspirations of Democratic Action and Henry Ramos Allup to preside over the new Legitimate National Assembly from January 5, 2021 are no secret.

 

Some factors thought that the official opposition wanted the Popular Consultation to extend the period of the current National Assembly. They did not need a Popular Consultation for that. Legal formulations are already being made that point to the "renewal" of the current Legitimate National Assembly in office, after the 6D-2020 elections being unknown (remember the second question of the Consultation). The proposal presented by Dr. Gerardo Fernandez on the occasion of the Inaugural Lesson of the 2020-2021 Academic Period at the Andres Bello Catholic University Law School, UCAB, entitled "The National Assembly and the Challenge of January 5. Constitutional vision of the topic" (see Dr. Fernandez's full presentation in Spanish at https://youtu.be/7LOaWRvU-R0) shows the path that the current deputies would take for a permanent National Assembly "until the Cessation of Usurpation", but with a "rotating" Presidency in charge decided by those deputies according to a new political agreement, where of course Guaido would not be the President in charge nor of the National Assembly.

 

This leads us to a conclusion that was obvious to us months ago, but apparently not so obvious to those who exercise the Government in Charge: the first person interested in Maduro ceasing his functions and expelling the Miraflores regime to begin a Transitional Government immediately and before January 5, 2021, SHOULD BE JUAN GUAIDO MARQUEZ. This makes all Venezuelans the main circumstantial allies of Guaidó, as opposed to those who need Maduro to stay to put their hands on a rotating G4 "Government in Charge", starting with Henry Ramos Allup and Acción Democrática, making them de facto allies of the regime.

 

Anything that is asked in a Popular Consultation that aims at the Cessation of the Usurpation of Maduro should be voted on MASSIVELY so that it has the sufficient and necessary force to remove the regime and generate a Transitional Government that is sustainable. THAT IS NOT WHAT THE MAIN PARTIES WANT when trying to sabotage the Cessation of Usurpation in the questions to the people of Venezuela. That is why they consciously eliminated the "Transition Government" from the first question of the Popular Consultation because they want elections next year with Maduro in Miraflores and from President of that "Transition" to Henry Ramos Allup, with his theory of the Authoritarian Enclaves (see Ramos Allup talks about the "Transition" in Spanish, in https://youtu.be/zzudMxJGnVU, min 0:52), which would allow them to COGOVER WITH THE SOCIALIST REGIME OF THE PSUV EVEN WITHOUT MADURO, responsible for crimes against Humanity, something that leaders of the official opposition are already blatantly saying.

 

I may disagree with the outcome of these questions, but I disagree even more with a "permanent" National Assembly holding hands in parallel with the regime in a kind of unlimited conchupancy where the ONLY loser is the Venezuelan people. It is in everyone's interest that the usurpation ceases IMMEDIATELY, regardless of who leads the Transition. AND THAT IS WHAT IS AT STAKE HERE. Unfortunately, a large part of the opposition political sector (with its few exceptions) is seeing that its political survival is guaranteed ONLY IF MADURO CONTINUES IN POWER. It is macabre but it is so...

 

Even though we have been tortured by the questions and they have not understood our proposal (or if they have, but some with power, it was convenient for something else), we have in front of us the scaffold of Juan Guaidó, and the worst thing is that I think he has not realized, because they have tried to minimize the formulation of the questions of the Popular Consultation by torpedoing the force of what the Popular Sovereignty can achieve. They should give us everything that we ask from civil society, putting all the resources that they have in that government in charge to leave this regime immediately.  But if they have not yet fully understood this, we are not going to allow them to do so in spite of themselves.

 

Let us vote en masse for that cessation of usurpation proposed now in the Popular Consultation and force the politicians to comply with the order to seek what is necessary internationally to remove these criminals from power. If we don't do it now, we will have the regime and its opposition negotiating our suffering for who knows how many more years. This Popular Consultation may be the last opportunity for Venezuelans to express themselves DIRECT AND CONSTITUTIONALLY before the world. I doubt that we will have that opportunity in the long future if we do not succeed. Let's use this last remaining loophole of Popular Power. Let's not waste it...
