The Non-Fraud of July 28th

Much has been said on social media about what really happened on July 28, 2024. In fact, everything that has been said could fill an entire book, perhaps titled “July 28: Myths and Realities.”

On one hand, the regime claimed that the opposition had “hacked” the electoral system, which, according to them, resulted in tally sheets favoring Edmundo González Urrutia (EGU). On the other hand, the opposition, led by María Corina Machado (MCM), attributed the victory to the organization of local “commands” in collecting all the tally sheets and the presence of external technicians who, in one way or another, “prevented” the regime from carrying out technical fraud. In the end, the fraud was consummated when the president of the National Electoral Council (CNE) appeared with his infamous “napkin” announcing the “victory” of Nicolás Maduro Moros.

However, the version that most closely reflects reality in this whole story, and which a group of experts who have worked on this topic for years, and among whom I am honored to participate, have begun to share publicly, refers to a thesis based on the sworn statement of a witness protected by the US federal authorities, which I mentioned in a previous article entitled “A Confession of Fraud no need for Proof” (see article in https://ticsddhh.blogspot.com/p/a-confession-of-fraud-no-need-for-proof.html).

The witness states in his testimony (see in Spanish, Texto Completo Declaración del Testigo Caso Tina Peters, in https://tinyurl.com/2k38ed86) that a group of technicians within Venezuela’s CNE manipulated the CNE’s automated system to alter electoral results—doing so since its original implementation in 2004, during the recall referendum against Hugo Chávez Frías—and that they were the actual perpetrators of this electoral crime, while also identifying its masterminds by name.

In this confession, related to a criminal investigation into technical fraud in the US, the witness begins by explaining that the system originated in Venezuela with Smartmatic, the company created to carry out said fraud, and that for one reason or another it ended up in the US, with the American company Dominion Voting Systems, to be used in the elections of that country. The plot is very complex and we discussed it in the second episode of the series “Sovereign Elections 202X”, on the Sin Filtros channel of journalist Maibort Petit (see in Spanish, Electoral Apartheid, with Guillermo Salas, Iñaki Gainzarain and Luis Manuel Aguana, in https://youtu.be/eI0Zjlxi8Zo?si=8GSHftHGwSNLt7fu).

However, judging by the results obtained, these technicians, for some publicly unknown reason, DID NOT MAKE the changes the regime expected at the appropriate time on election day, July 28th. This resulted in the REAL numerical outcome in all the tally sheets issued by the system at the close of the election on July 28, 2024, unlike the manipulation the National Electoral Council (CNE) had consistently exhibited since 2004. Therefore, we are witnessing not electoral fraud, but rather a technical-electoral NON-fraud on July 28th.

These “angels,” as mathematician Guillermo Salas refers to them in the second episode of the series, were in reality the unsung heroes of this entire tragedy. Had they been operating and implementing the changes to the results from the CNE servers, as the regime had planned, the July 28th tally sheets would not have reflected the true popular will, and the opposition would have been unable to make any claims whatsoever. The witnesses and the opposition's evidence-gathering operation would have collected altered ballots, that is, the victory of Nicolás Maduro Moros, exactly as had occurred in Venezuela since 2004.

I won't go into detail here about how these technicians have carried out the changes since 2004. I already did so in a previous article, but it fundamentally centers on the manipulation of the results in machines that are not audited, or as the National Electoral Council (CNE) puts it, are not subject to the citizen verification described by Venezuelan electoral law and its regulations, as I theorized 13 years ago (see in Spanish, When a Theory Became Evidence, https://ticsddhh.blogspot.com/p/when-theory-became-evidence.html). That is to say, 46% of the voting machines. It is there that the manipulation of results takes place. This is no longer a matter of indications of fraud—as we have consistently denounced—but rather a confession of the Venezuelan regime's electoral crime.

And this must have political consequences, beginning with the imperative need and urgency to fundamentally—structurally, technically, legally, and procedurally—reform the Venezuelan electoral system before holding another election in our country. It is now confirmed through this declaration that HUGO CHÁVEZ FRÍAS DID NOT WIN THE 2004 RECALL REFERENDUM, as we had previously suggested based on circumstantial evidence. WE CAN NOW ASSERT THIS WITH ABSOLUTE CERTAINTY.

Taking advantage of the incredible technical tools available to anyone online, I asked an AI—specifically Claude, model Sonnet 4.6—to take my 2013 presentation and compare it with the aforementioned 30-plus-page statement submitted by the protected witness. I also asked it to calculate how closely this theory aligned with reality, quantifying it as a percentage, and to present a comprehensive comparative report. All this technical effort—aimed at revealing what actually transpired in Venezuela and the consequences it is having beyond our borders—should ideally yield a result manifested in a change of attitude among the various political actors. Yet, paradoxically and astonishingly, nothing could be further from the truth at this moment.

The public continues to be fed a misleading narrative regarding the events of July 28, 2024, attributing the success of that day to factors that—while indeed necessarily present (namely, the poll watchers and their organization)—did not, in reality, have a direct bearing on the final outcome of the event. It is clear that without the collected tally sheets, the results could not have been presented to the world; we therefore acknowledge and commend MCM’s opposition organization for their efforts. However, had the contents of those tally sheets not reflected the actual reality, July 28th would have been just another day of frustration for the Venezuelan people.

If, in fact, those tally sheets revealed the true will of the Venezuelan people, it was only because certain "demons"—who, at the eleventh hour, had morphed into "angels"—were not present to tamper with the results of the July 28th election. Subsequently, these very "angels" surfaced in the United States, where they testified in a case involving electoral fraud committed in that country—fraud allegedly perpetrated using the same electoral software, albeit running on Dominion Voting Systems machines within the U.S. electoral framework.

The most important point to emphasize here is that, from the very beginning of this whole story, the 2004 Recall Referendum against Hugo Chávez Frías, what we, the experts who warned of this fraud by the regime, always presented were mathematical indications of manipulation of the fraud (see Guillermo Salas, video summary in Spanish of his book, The Power of Mathematics, in https://youtu.be/dCBCfc3z0H8), but never such direct evidence as the statement of the perpetrator.

At this juncture, what we ought to be hearing Venezuelan opposition politicians declaring far and wide should not be—precisely—a call for “elections now,” nor even an apology to those of us who warned them for over 20 years that the regime’s automated system at the CNE was a fraud that stole elections from us whenever it yielded inconsistent results. Instead, we should be hearing serious proposals regarding what they intend to do to begin rectifying Venezuela’s electoral system before participating in another election—among other reasons—because that system was transformed into the primary pillar sustaining a tyranny that has destroyed the country. And, contrary to what we had expected, what they historically did was back that system—technically and politically—time and again, in a manner that was both complicit and brazen.

Nevertheless, what we continue to hear from the opposition at this critical juncture—time and again—is more of the same: a call for elections, utilizing the exact same existing technical, legal, and procedural framework, and attempting to persuade the population to go to the polls against the regime once more. They do so using the specious argument that the opposition victory of July 28, 2024, will be replicated. Even if the “devils”—now transformed into “angels”—are no longer manipulating the system (which was initially operated by Smartmatic and is now run by Ex-Clé)—thanks to the U.S. judicial system—rest assured that they already have replacements waiting in the wings for the next election; only this time, the tyranny will be fully prepared to keep the “Rodrigato” in power. If given the chance, next time around, there will be no “Non-Fraud” outcome…
